Eviction Process and Fee Breakdown

All fees listed below are approximate

  • “7 Day Notice” is mailed if rent is not received by the 5th
    • No Fee

 

  • “Summons & Complaint” can be filed 7 business days after the notice has been mailed
    • $45-110 filing fee and $27 service fee per defendant

 

  • 2-3 weeks after “Summons & Complaint” is filed we will receive a scheduled court date

 

  • 4-6 weeks after filed – tenant appears in court for eviction proceedings and judgment
    • Attorney fee for appearance in court
      • Detroit / Wayne County $150
      • Oakland County $175
      • Macomb County $250
      • Livingston County $250

There are 2 types of judgments which can be entered against the tenant

  • Default judgment means that the tenant didn’t appear and the judge signed the “Summons & Complaint” giving the tenant 10 days to pay or move
  • Consent Judgment means that the tenant consents to move out of the property or made a payment arrangement to bring the rent current in X amount of days

 

If the tenant doesn’t respond by paying within the allotted time or does not vacate the property, the next step is to file a “Writ”. This document must be signed by the judge allowing the Bailiff, an officer of the court, to physically remove the tenant and their belongings from the property.

  • The “Writ” can be filed after the judgment has been entered if tenant doesn’t pay or move within the allotted time frame per the judgment entered.
    • $75 Writ filing fee
  • Approximately 2 weeks for the Writ to be signed and processed by the judge and sent to the bailiff’s office to be carried out.
  • Approximately 1 week before the bailiff will call us to schedule the eviction
    • $150 minimum charge for them to go out and cost can reach over $1000 depending on tenant’s belongings in the house.
    • A dumpster must be delivered to the property for the bailiff

    • A representative for the property must be onsite to meet the bailiff with payment for the eviction upon completion.
